If such data is transmitted, it is done at the Client’s discretion and responsibility.

Client organizations retain ownership of their data, including contacts, communications, and CRM records

Clients act as the Data Controller

Big Hit Creative acts as the Data Processor

We process data solely to provide services.

We do not sell personal data.

5. How We Use Information

Operate and deliver platform functionality

Route communications and automate workflows

Generate reports, transcripts, and summaries

Improve system performance and AI accuracy

Provide support and troubleshooting

Monitor compliance and proper platform usage

6. Messaging & Communication Responsibility

ConnectXL™ provides tools for SMS, email, voice, and automated communication.

We do not initiate communications on behalf of clients

Clients control all messaging activity

Clients are solely responsible for obtaining consent and complying with applicable laws, including the Telephone Consumer Protection Act (TCPA) and CAN-SPAM Act

We do not sell or share SMS opt-in data.

7. Third-Party Providers

We rely on third-party providers to deliver services, including but not limited to:

GoHighLevel – CRM and workflow management

Twilio – voice, SMS, and call routing

IBM WatsonX – AI governance and processing

OpenAI – language processing

RingCentral – voice routing and transfers

Zapier – integrations

These providers act as sub-processors.

We do not control and are not responsible for:

Third-party outages or failures

Data breaches caused by third parties

Third-party data handling practices

8. Data Retention

Data is retained only as necessary to provide services or meet legal requirements:

Call recordings: typically 30–180 days (configurable)

Transcripts: typically 60–90 days

CRM data: while account remains active

Demo or inquiry data: up to 24 months

We do not guarantee data retention after account termination.

9. Legal & Regulatory Support

ConnectXL™ is designed to support compliance considerations including:

GDPR / UK GDPR

CCPA / CPRA

FERPA (education privacy)

HIPAA-ready configurations (where contractually agreed)

Clients are responsible for ensuring their own compliance.
