BHC ConnectXL™ — Privacy Policy

Welcome to ConnectXL™, an intelligent communication solution developed and powered by Big Hit Creative Group, LLC (“Big Hit Creative,” “we,” “us,” or “our”). ConnectXL™ enables organizations to automate branded voice, SMS, and chat interactions using secure AI-driven communication tools. By accessing or using ConnectXL™, you agree to the terms described below.


1. Description of Services

ConnectXL™ provides automated communication technology, which may include:

• AI-powered voice assistants, SMS, and chat automation
• Call handling, routing, lead capture, appointment scheduling
• Call summaries, voicemail transcripts, and CRM synchronization
• Brand-aligned voice training and language support
• Integrations with CRM, scheduling, messaging, or call transfer systems

ConnectXL™ is a communication enhancement platform. It does not replace human judgment and does not provide legal, medical, or professional advice.


2. No Guarantee of Performance or Results

Big Hit Creative does not guarantee specific outcomes or results, including but not limited to:

• Conversion rates, lead volume, or sales performance
• Appointment attendance, enrollment outcomes, or revenue results
• Reduced call volumes or response times
• Error-free performance of AI or automation tools

The performance of ConnectXL™ depends on user configuration, call quality, data accuracy, system integrations, and the client’s internal processes. No warranties are made regarding business outcomes.


3. Call Recording, AI Interaction, and Consent

ConnectXL™ may process:

• Live voice calls
• Call recordings and voicemail
• AI-generated transcripts and summaries
• SMS, email, and chat messages
• Appointment and scheduling details

In certain jurisdictions, clients may be legally required to notify callers of recording or AI involvement. ConnectXL™ can provide sample consent language, but clients are responsible for obtaining appropriate consent when required.


4. Data Ownership and Roles

Client organizations own their own communication data, including leads, call records, and CRM entries. Roles are defined as follows:

• The client organization is the data controller.
• Big Hit Creative (ConnectXL™) is the data processor.
• Technology partners such as Twilio, IBM, GoHighLevel, OpenAI, or RingCentral may act as sub-processors.

We process information only for the purpose of delivering ConnectXL™ services. We do not sell personal data.


5. AI Limitations

ConnectXL™ uses artificial intelligence to interpret and respond to voice and text inputs. While the system improves over time, no AI model is perfect. Errors may occur, including:

• Misinterpretation of questions
• Incorrect routing or call handling
• Incomplete information summaries
• Automated misunderstandings

Clients must ensure that critical or sensitive interactions (such as healthcare, legal, or crisis communications) are handled by qualified personnel. ConnectXL™ should not be relied upon for emergency response, medical or legal advice, or compliance decision-making.


6. Acceptable Use

You agree not to:

• Use ConnectXL™ for illegal, fraudulent, or harmful purposes
• Collect or store sensitive personal information (such as full medical or legal records) unless specifically approved
• Use the system for emergency response (911, crisis intervention, or law enforcement interviews)
• Harass, discriminate, or mislead users through AI interactions
• Record or store conversations without legally required consent

Big Hit Creative may suspend access to ConnectXL™ for violations of applicable laws, misuse, or security concerns.


7. Third-Party Platforms and Providers

ConnectXL™ integrates with and relies on third-party platforms to function, including but not limited to:

• GoHighLevel – CRM, automation, and workflow tools
• Twilio – voice, SMS, recording, and phone routing
• IBM WatsonX – AI governance, audit, and compliance
• OpenAI – AI language processing
• RingCentral / Office@Hand – call transfer and routing
• Zapier or similar platforms – API and custom integrations

Big Hit Creative is not responsible for outages, limitations, or pricing changes made by third-party providers.


8. Service Interruptions

Service may be temporarily interrupted due to maintenance, telecom provider outages, third-party disruptions, or technical errors. Big Hit Creative is not liable for call interruptions, missed calls, loss of connectivity, or downtime caused by third-party infrastructure.


9. Intellectual Property

Ownership rights are defined as follows:

• Big Hit Creative owns ConnectXL™ software, voice models, branding, scripts, workflows, and system architecture.
• Clients own their organizational data, contacts, lead information, and communication records.
• Voice or tone profiles created specifically for a client may be licensed for use by that client but do not transfer full ownership.

Clients may not reverse engineer, resell, distribute, or claim ownership of ConnectXL™ technology without written authorization.


10. Limitation of Liability

To the fullest extent permitted by law:

• Big Hit Creative is not liable for any indirect, incidental, or consequential damages.
• We are not responsible for lost leads, missed calls, service interruptions, or business loss.
• We are not liable for regulatory penalties arising from how the client deploys or uses the service.
• The maximum total liability in any claim shall not exceed the total fees paid to Big Hit Creative in the preceding 12 months.


11. Termination

We may suspend or terminate access to ConnectXL™ if:

• Fees are unpaid
• The system is misused or used unlawfully
• Compliance or ethical concerns arise
• The client requests termination per contract terms

Termination does not relieve the client of any outstanding payment obligations.


12. Policy Updates

These Terms may be updated as ConnectXL™ evolves. The most current version will be posted on our website and will govern future use of the service. Continued use after updates signifies acceptance of the revised Terms.
