Big Hit Creative Group, LLC (“Big Hit Creative,” “we,” “us,” or “our”) provides ConnectXL™, a communication and automation platform.
By accessing or using ConnectXL™, you agree to these Terms of Service. If you do not agree, you may not use the platform.
1. Description of Services
ConnectXL™ provides communication and automation tools, which may include:
AI-powered voice, SMS, and chat automation
Call routing, lead capture, and appointment scheduling
Call summaries, transcripts, and CRM synchronization
Workflow automation and integrations
ConnectXL™ is a technology platform only and does not replace human judgment or provide legal, medical, or professional advice.
2. No Guarantee of Results
We do not guarantee:
Leads, conversions, or revenue
Call handling outcomes or response times
Message delivery or system performance
Accuracy of AI-generated responses
All services are provided “as is” and “as available.”
3. Client Responsibilities
You are solely responsible for:
Your use of the platform
Data accuracy and usage
Compliance with all applicable laws
4. Communication & Consent Compliance
ConnectXL™ enables SMS, voice, and automated communication.
You agree to:
Obtain express written consent before sending messages or recording calls
Maintain records of consent
Comply with all applicable laws, including the Telephone Consumer Protection Act (TCPA) and CAN-SPAM Act
Big Hit Creative does not initiate communications on your behalf and is not responsible for your messaging practices.
5. Call Recording & AI Processing
ConnectXL™ may process:
Voice calls and recordings
Transcripts and summaries
SMS, email, and chat communications
You are responsible for providing any legally required disclosures or consent related to recording or AI usage.
6. Data Ownership & Roles
You own your data, including contacts, communications, and CRM records
You are the Data Controller
Big Hit Creative is the Data Processor
We process data only to provide services and do not sell personal data.
7. AI Limitations
AI-generated responses may be inaccurate or incomplete.
ConnectXL™ should not be used for:
Emergency services
Medical, legal, or financial advice
Critical decision-making without human oversight
8. Acceptable Use
You may not:
Use the platform for illegal, deceptive, or harmful purposes
Send spam or unauthorized communications
Collect or process sensitive data without proper authorization
Interfere with platform performance or security
We may suspend or terminate access immediately for violations.
9. Third-Party Services
ConnectXL™ relies on third-party providers, including:
GoHighLevel
Twilio
IBM WatsonX
OpenAI
RingCentral
Zapier
We do not control and are not responsible for:
Outages or service interruptions
Data breaches caused by third parties
Changes in pricing or availability
10. Service Interruptions
Service may be interrupted due to maintenance, third-party outages, or technical issues.
We are not liable for:
Missed calls
Lost data
Downtime or connectivity issues
11. Payment, Billing & Chargebacks
Services may be subscription-based and billed automatically
All payments are non-refundable unless otherwise stated
Chargebacks are prohibited.
Any chargeback constitutes a breach of this Agreement, and you are responsible for all associated fees, legal costs, and recovery expenses.
12. Disclaimer of Warranties
To the maximum extent permitted by law:
ConnectXL™ is provided without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
13. Limitation of Liability
To the fullest extent permitted by law:
We are not liable for indirect, incidental, consequential, or punitive damages
We are not responsible for lost revenue, missed opportunities, or business interruption
We are not liable for regulatory penalties arising from your use of the platform
Total liability is limited to the amount paid in the previous 30 days
14. Indemnification
You agree to defend, indemnify, and hold harmless Big Hit Creative from any claims, damages, liabilities, or legal expenses arising from:
Your use of the platform
Violations of communication or privacy laws
Unauthorized messaging or data use
15. Suspension & Termination
We may suspend or terminate access immediately, without notice, if:
Payments are not made
The platform is misused
Legal or compliance risks arise
Termination does not remove your obligation to pay outstanding balances.
16. Dispute Resolution
All disputes shall be resolved through binding arbitration in Dallas County, Texas.
You agree to waive any right to participate in a class action lawsuit.
17. Limitation on Claims
Any claim must be brought within 6 months of the event giving rise to the claim.
18. Force Majeure
We are not liable for delays or failures caused by events beyond our control, including:
Internet outages
Telecom failures
Natural disasters
Third-party service disruptions
19. Intellectual Property
Big Hit Creative owns all platform technology, systems, and materials
You are granted a limited, non-transferable license to use the platform
You may not copy, resell, or reverse engineer ConnectXL™.
20. Updates to Terms
We may update these Terms at any time.
Continued use of ConnectXL™ constitutes acceptance of updated Terms.
